End-User License Agreement (EULA) of Crashers

This End User License Agreement (the “Agreement”) is a legal agreement between you (the “User”) and Noodle Games Inc. (“Noodle Games,” “we,” “us,” or “our”) regarding your use of the game Crashers (the “Game”). By installing, accessing, or using the Game, you agree to be bound by the terms and conditions of this Agreement.

  1. License Grant

Subject to your compliance with the terms of this Agreement, we grant you a limited, non-exclusive, non-transferable, and revocable license to install and use the Game for personal, non-commercial purposes on compatible devices that you own or control.

  1. Ownership

The Game and all intellectual property rights therein, including but not limited to copyrights, trademarks, and trade secrets, are owned by Noodle Games and its licensors. This Agreement does not grant you any ownership rights or interests in the Game.

  1. Restrictions

You agree not to: a. Copy, distribute, or modify the Game, in whole or in part. b. Reverse engineer, decompile, or disassemble the Game, except to the extent permitted by applicable law. c. Remove or alter any proprietary notices or labels on the Game. d. Use the Game for any illegal or unauthorized purpose. e. Interfere with or disrupt the operation of the Game or servers. f. Use the Game in a manner that violates the rights of any third party. g. Attempt to gain unauthorized access to any portion of the Game or any related systems or networks.

  1. User Content

You may have the opportunity to submit or create content within the Game (“User Content”). By submitting User Content, you grant Noodle Games a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with the Game and Noodle Games’ business operations.

  1. Updates and Modifications

Noodle Games may release updates, upgrades, or modifications to the Game from time to time. You agree that such updates or modifications may be required for continued use of the Game and that this Agreement applies to any updated or modified versions of the Game.

  1. Privacy

Your use of the Game is subject to our Privacy Policy, which outlines how we collect, use, and disclose your personal information. By using the Game, you consent to the collection, storage, and processing of your information as described in the Privacy Policy.

  1. Disclaimer of Warranty

The Game is provided “as is” without warranties of any kind, whether express or implied. Noodle Games disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Noodle Games does not warrant that the Game will be error-free, uninterrupted, or secure.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Noodle Games be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Game, even if Noodle Games has been advised of the possibility of such damages.

  1. Termination

We may terminate this Agreement at any time without notice if you fail to comply with its terms. Upon termination, you must cease all use of the Game and destroy any copies of the Game in your possession.

  1. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

  1. Severability

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired.

  1. Entire Agreement

This Agreement constitutes the entire agreement between you and Noodle Games regarding the subject matter herein and supersedes all prior or contemporaneous agreements, understandings, or representations.
