Terms of Service

Welcome to Crashers! These Terms of Service (“Terms”) govern your use of Crashers, a multiplayer battle arena game developed by Noodle Games Inc. (“Noodle Games,” “we,” or “us”). By accessing or using Crashers, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use Crashers.

  1. Acceptance of Terms 

By accessing or using Crashers, you affirm that you are at least 18 years old or have obtained parental consent. You acknowledge that these Terms constitute a legally binding agreement between you and Noodle Games.

  1. User Accounts 

To access certain features of Crashers, you may need to create a user account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You agree to provide accurate and complete information when creating an account and to promptly update any information that may change.

  1. Privacy 

Noodle Games respects your privacy and handles your personal information in accordance with our Privacy Policy. By using Crashers, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

  1. Collection of Information 

In order to provide you with a seamless gaming experience, Crashers may collect certain information from you, including but not limited to your username, password, email address, and gameplay data. By using Crashers, you grant Noodle Games the right to collect, use, store, and disclose this information as outlined in our Privacy Policy.

  1. Ownership and Intellectual Property 

Crashers and all associated content, including but not limited to graphics, designs, characters, and trademarks, are the property of Noodle Games or its licensors. You acknowledge and agree that you have no ownership or other proprietary rights in Crashers, except for the limited license granted to you to use Crashers in accordance with these Terms.

  1. Prohibited Conduct 

While using Crashers, you agree not to:

a) Violate any applicable laws or regulations of Ontario, Canada; 

b) Infringe upon the rights of others; 

c) Attempt to gain unauthorized access to Crashers or other users’ accounts; 

d) Use Crashers for any unlawful, harmful, or malicious purposes; 

e) Engage in cheating, hacking, or any other form of unfair play; 

f) Harass, intimidate, or threaten other users; 

g) Interfere with or disrupt the operation of Crashers; 

h) Use automated scripts or bots to access or interact with Crashers; 

i) Promote or distribute unauthorized third-party software or services related to Crashers.

  1. Third-Party Links and Services 

Crashers may contain links to third-party websites or services that are not owned or controlled by Noodle Games. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your interactions with such third parties are solely between you and the third party, and we encourage you to review the terms and policies of any third-party website or service that you visit.

  1. Modification or Termination of Crashers 

Noodle Games reserves the right to modify, suspend, or terminate Crashers or any part of it at any time without prior notice. We may also impose limits on certain features or restrict your access to Crashers without liability.

  1. Disclaimer of Warranties 

Crashers is provided on an “as is” and “as available” basis. Noodle Games makes no warranties or representations, express or implied, regarding Crashers or its operation. To the fullest extent permissible under applicable law, Noodle Games disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  1. Limitation of Liability 

To the extent permitted by law, Noodle Games and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of Crashers.

  1. Governing Law and Jurisdiction 

These Terms shall be governed by and construed in accordance with the laws of the province of Ontario, Canada. Any legal action or proceeding arising out of or relating to these Terms or your use of Crashers shall be exclusively brought in the courts located in the province of Ontario, and you consent to the personal jurisdiction of such courts.

  1. Entire Agreement 

These Terms constitute the entire agreement between you and Noodle Games regarding your use of Crashers and supersede any prior or contemporaneous understandings.

  1. Severability 

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
